Terms of service

These Terms of Service ("Terms") govern your access to and use of KnowItBy, a membership-based study planning service available through knowitby.com and its related account and application pages (the "Service"). By creating an account, starting a trial, purchasing a membership, or using the Service, you agree to these Terms and our Privacy Policy, Subscription and Cancellation Policy, and Refund Policy.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms and supervise your use. You may not use the Service if applicable law prohibits you from doing so.

2. Your account

You must provide accurate information and keep your account information current. Your account is personal to you. You are responsible for protecting access to your email, devices, and sign-in methods and for activity conducted through your account. Notify us promptly if you suspect unauthorized access.

3. Membership, free trial, and recurring billing

KnowItBy is offered as an automatically renewing membership. The selected price, billing interval, trial terms, renewal date, and any applicable taxes are displayed before you complete checkout. Unless you cancel before the trial ends, the payment method you provide will be charged automatically when the seven-day free trial ends and at each selected renewal interval until cancellation.

Current plan prices are $1.99 per week, $6.99 per month, or $69.99 per year, subject to applicable taxes and any price change disclosed to you in advance. Detailed terms, cancellation instructions, plan changes, and failed-payment rules are in our Subscription and Cancellation Policy.

4. The Service

KnowItBy lets members search for source-verified public profiles for tests, courses, certifications, textbook editions, and other academic goals; create private study projects; upload or paste study material; set goals and deadlines; complete diagnostic activities; receive study missions; and view readiness estimates. A public profile contains metadata and citations, not a promise that KnowItBy has the full course, textbook, or assessment. Features may change as we improve the Service. We may apply reasonable limits to file types, file size, storage, searches, or usage to protect security and performance.

When an AI-enabled study feature is available to your account and you use it, selected portions of your User Content and relevant project settings may be processed by OpenAI for KnowItBy to generate study materials. Automated output is validated where described in the Service but may be incomplete or incorrect. You remain responsible for reviewing it and for using the Service consistently with your school, employer, publisher, and applicable academic-integrity rules.

5. Educational disclaimer

KnowItBy is a supplemental study-planning tool. It is not a school, tutoring credential, testing authority, or substitute for a teacher, licensed professional, course material, or your own judgment. Readiness scores, schedules, explanations, questions, and recommendations are estimates and may contain errors. We do not guarantee any grade, examination result, admission decision, certification, or academic outcome.

6. Your content

You retain ownership of study material and other content you submit ("User Content"). You grant KnowItBy a limited, non-exclusive license to host, copy, process, transform, and display User Content only as needed to provide, secure, and support the Service for you and to comply with law. This license ends when the content is deleted from active systems, subject to reasonable backup retention and legal obligations.

You represent that you have the right to submit User Content. Do not upload content that is unlawful, infringes copyright or other rights, contains malware, violates school or testing rules, or includes highly sensitive personal information that is not needed for studying. You are responsible for deciding whether your school, employer, publisher, or other rights holder permits uploading particular material.

7. Acceptable use

You may not:

  • use the Service for illegal, fraudulent, deceptive, abusive, or harmful activity;
  • access or attempt to access another customer's account, projects, files, or membership;
  • bypass membership controls, security measures, rate limits, or access restrictions;
  • probe, scan, reverse engineer, scrape, disrupt, or overload the Service except where law expressly permits;
  • upload malicious code or content that violates another person's privacy or intellectual-property rights;
  • ask the Service to locate, reproduce, or provide leaked assessments, stolen test banks, pirated textbooks, restricted or classified material, copyrighted full text you are not authorized to use, or answers to a live graded assessment;
  • resell, sublicense, or share membership access; or
  • use the Service to cheat, violate an academic-integrity policy, or obtain unauthorized access to an assessment.

8. KnowItBy intellectual property

The Service, including its software, design, branding, interface, and original content, is owned by KnowItBy or its licensors and protected by applicable law. These Terms give you a limited, revocable, non-transferable right to use the Service for your personal study purposes during an active trial or membership.

9. Third-party services

The online storefront, customer accounts, checkout, and related commerce functions are hosted by Shopify. Shopify collects and processes customer personal data to provide those functions and, when Shopify Network Intelligence is enabled, to provide enhanced services such as personalization, analytics, store performance, and more relevant advertising. Information about activity on the storefront may be shared with Shopify and service providers in the United States or other countries as described in our Privacy Policy and the Shopify Consumer Privacy Policy.

The Service also relies on PayWhirl for recurring membership management, OpenAI for AI-enabled study features, and infrastructure, payment, and optional identity providers. Their services may be subject to separate terms and privacy policies. KnowItBy is not responsible for third-party services outside our reasonable control. Our Privacy Policy explains what information each category of provider may process.

10. Service availability and changes

We aim to keep the Service reliable but do not promise uninterrupted or error-free operation. We may maintain, update, suspend, or discontinue features for security, legal, operational, or product reasons. If we discontinue the paid Service as a whole, we will provide notice and any refund required by law.

11. Suspension and termination

You may stop using the Service or cancel your membership at any time. We may restrict or terminate access if you materially violate these Terms, fail to pay, create security or legal risk, or misuse the Service. Where reasonable, we will provide notice and an opportunity to correct the issue. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations, and dispute provisions.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." KnowItBy disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

13. Limitation of liability

To the maximum extent permitted by law, KnowItBy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, opportunity, profits, academic credit, or examination results, arising from the Service. KnowItBy's total liability for claims relating to the Service will not exceed the greater of the amount you paid to KnowItBy during the 12 months before the event giving rise to the claim or $100. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

14. Indemnity

To the extent permitted by law, you agree to defend and indemnify KnowItBy against third-party claims resulting from your unlawful use of the Service, your User Content, or your material violation of these Terms. This section does not require you to indemnify KnowItBy for its own wrongful conduct.

15. Governing law and disputes

These Terms are governed by the laws of Arkansas and applicable United States federal law, without regard to conflict-of-law rules. Before filing a claim, you and KnowItBy agree to make a good-faith effort to resolve the dispute by contacting the other party. Any court proceeding must be brought in a court with lawful jurisdiction in Arkansas, except where consumer law gives you the right to proceed elsewhere.

16. General terms

If any provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or sale of the Service. These Terms and the policies incorporated above are the entire agreement regarding the Service.

17. Changes

We may update these Terms. If a change materially affects your rights or an active paid membership, we will provide notice as required by law. Continuing to use the Service after the effective date of updated Terms constitutes acceptance where permitted by law.
